The plain part first: use Ninety Sky for the umbrella, not for safety.
These terms are an agreement between you and Ali Yazdi ("we", "us"), who makes Ninety Sky. By using the app, its widgets, the website or our servers (together, "the service"), you agree to them. If you don't agree, please don't use the service.
Ninety Sky is in early access. Everything is free for now, and features may change, improve or go away as we learn. Some features, such as longer-range forecasts or rain alerts, may later be offered as a paid subscription. You'll never be charged unless you choose to buy something through Apple, and we'll tell you clearly what's free and what isn't before anything changes.
Forecasts are estimates. Ninety Sky shows its own uncertainty on purpose, and it can still be wrong, late, or unavailable. Alerts can arrive late or not at all. Don't rely on the service for decisions about safety, travel in severe weather, or anything where a mistake could hurt someone or cause loss.
For warnings and emergencies, follow the National Weather Service (weather.gov) and your local authorities.
We give you a personal, non-exclusive, non-transferable, revocable license to use the service for your own non-commercial purposes. Please don't:
If you send us ideas or feedback, you let us use them to improve Ninety Sky, without owing you anything. We'll never publish your name or email without asking.
The app, the website, the design and the forecasts they produce belong to us, apart from third-party data and software, which belong to their owners and are credited on the credits page. Weather data from NOAA and the National Weather Service is public domain. Map data is © OpenStreetMap contributors and © Apple and its data providers.
We may change, pause or stop any part of the service at any time. We may update these terms; the date above shows when they last changed, and if you keep using the service after a change, the new terms apply. We may suspend access for anyone who breaks these terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT THE LAW ALLOWS, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM WEATHER, FORECASTS, ALERTS OR THEIR ABSENCE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE PAST 12 MONTHS OR US$50. Some places don't allow these limits, so they may not all apply to you.
You agree to indemnify us against claims arising from your misuse of the service or your breaking these terms.
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts in Mecklenburg County, North Carolina, and you and we consent to their jurisdiction. If any part of these terms can't be enforced, the rest still applies.
Where these terms and Apple's Licensed Application End User License Agreement differ, these terms apply to the extent allowed.
